Legal guarantee of conformity

For a consumer purchase, “ЛАТРАНД” ЕООД is liable for a lack of conformity of the goods that exists at delivery and becomes apparent within two years of delivery. These are your statutory rights under the Act on the Supply of Digital Content and Digital Services and the Sale of Goods, and do not depend on a warranty card or an additional commercial warranty.

If the lack of conformity appears during the first year, it is presumed to have existed at delivery unless proved otherwise or unless this is incompatible with the nature of the goods or the lack of conformity. The complaint period is suspended for the time needed for repair or replacement.

Your rights

You may request repair or replacement. The chosen remedy may be refused if it is impossible or entails disproportionate costs compared with the other remedy, taking account of the goods’ value, the significance of the lack of conformity and the inconvenience to you.

Repair or replacement is carried out free of charge and without significant inconvenience. For goods without digital elements, the period is up to one month from notification; for goods with digital elements, it is a reasonable period according to their nature and purpose. The seller bears the necessary transport, material and labour costs. Where the law requires it for correctly installed goods, we also cover the necessary removal and reinstallation.

You may request a proportionate price reduction or termination of the contract on statutory grounds, for example where repair or replacement is refused or not carried out within the required period, where non-conformity recurs or where a defect is sufficiently serious. For durable goods and goods with digital elements, the law allows a second attempt to bring them into conformity. A minor lack of conformity does not entitle you to terminate the contract; the seller must prove that it is minor.

Goods with digital elements

For smart devices and other goods with digital elements, the rules also cover the digital content or service needed for their operation. Requirements apply to updates, including security updates, and conformity throughout the period set by law or contract. Where the manufacturer provides information on the minimum update period, it is stated for the relevant goods. No common, identical period is promised for all devices.

Additional commercial warranty

If the product has an additional commercial warranty, its specific duration, scope, guarantor and claim procedure are stated in the warranty statement and product information. It supplements statutory rights and cannot reduce them. More favourable advertised terms are honoured under the applicable rules.

Damage and documents

Normal wear or damage genuinely caused by misuse, external influences or repair may not constitute a lack of conformity for which the seller is liable. Each case is assessed according to its cause and the product’s characteristics. Batteries and consumables are not entirely excluded from statutory protection; lost packaging, a warranty card or an original receipt do not automatically terminate these rights.
